1. About these terms
These terms and conditions ("Terms") apply between you and [Company legal name], registered at [Registered address] ("PlugEV", "we", "us"). They govern your use of our website, the PlugEV mobile app, the PlugEV EV charging network, and any purchase of chargers or installation services from us. By using our Services you agree to these Terms. If you don't agree, please don't use the Services.
Nothing in these Terms limits rights you have under consumer-protection law that cannot be excluded.
2. Using our website
- Website content is for general information. Charger specifications, availability and illustrative figures (including the revenue calculator) are estimates, not offers or guarantees.
- You must not misuse the website, including by attempting unauthorised access, introducing malware, scraping at scale or submitting false or misleading information through our forms.
- Links to third-party websites are provided for convenience; we're not responsible for their content.
3. The PlugEV app and your account
- You must be at least 18 years old (or the age of majority where you live) to create an account and pay for charging.
- You're responsible for keeping your login details and any PlugEV RFID card secure, and for all sessions started with your account or card. Tell us immediately if your card is lost or you suspect unauthorised use.
- Charger availability shown in the app is provided in real time where possible, but may not always be accurate. We don't guarantee that a charger will be available or working when you arrive.
- We may update the app to improve features, security or compliance.
4. Charging sessions
- PlugEV chargers supply AC power through a Type 2 connector. Actual charging speed depends on your vehicle's on-board charger, battery state, temperature, site load management and other factors, and may be lower than the charger's maximum rated power.
- A session starts when it is authorised through the app, QR payment or RFID card and ends when you stop it, the vehicle stops accepting energy, or the session is ended for safety or technical reasons.
- You must use chargers only with compatible vehicles and undamaged cables and adapters, and follow instructions displayed on the charger and in the app.
- If a session fails because of a fault with our charger, you won't be charged for energy that wasn't delivered.
5. Pricing and payment
- Prices are set per location, usually per kWh, and may include time-based or idle fees. The applicable price is shown in the app and/or at the charger before you start a session. Prices include applicable taxes unless stated otherwise.
- Idle fees: at some locations, an idle fee applies after a stated grace period once charging completes, if your vehicle remains connected. Any idle fee is shown before you start.
- We may place a temporary pre-authorisation on your payment method when a session starts. It's released or adjusted to the final amount when the session ends.
- Parking charges or time limits set by the site owner may apply separately and are the responsibility of the driver.
- If you believe you've been charged incorrectly, contact us within 60 days of the session and we'll investigate.
6. Driver responsibilities
- Park only in bays marked for EV charging, and only while charging or within any posted time limit.
- Don't tamper with, damage or modify any charger, cable or signage. Report damage or faults via the app or support line.
- Stop using a charger immediately if you notice damage, overheating, unusual smells or sounds.
- You're responsible for damage caused by your negligence or misuse, including use of faulty adapters or cables.
7. Charger sales and installation
- Quotes: quotes are valid for 30 days unless stated otherwise and are based on information you provide and our site survey. Unforeseen conditions (for example, inadequate supply, hidden obstructions or required civil works) may require a revised quote, which we'll agree with you before proceeding.
- Orders: a contract is formed when you accept our written quote and pay any required deposit.
- Site readiness: you must provide safe access, accurate site information and any landlord, building-management or local approvals that are your responsibility.
- Delivery and installation dates are estimates. We'll keep you informed of any delays.
- Title and risk: risk passes to you on delivery or installation; ownership passes when you have paid in full.
- Payment: invoices are payable within the period stated on the invoice. We may charge interest on late payments where permitted by law.
8. Warranty, cancellations and returns
- PlugEV chargers carry a manufacturer's warranty of 3 years from installation (or longer if stated in your quote or maintenance plan) against defects in materials and workmanship.
- The warranty doesn't cover damage from misuse, accidents, unauthorised modification or repair, installation not carried out or approved by PlugEV, power surges outside specification, or normal wear and tear.
- Consumers may have a statutory right to cancel certain orders within a cooling-off period. Where you've asked us to start installation within that period, you may have to pay for work already performed.
- Uninstalled, unused products in original packaging may be returned within [14] days of delivery, subject to a restocking fee of up to [10]% where permitted by law.
9. Host partners
Businesses and landowners hosting PlugEV chargers under the Host & Earn, Land Lease or Own & Operate models enter into a separate written host agreement. If that agreement conflicts with these Terms, the host agreement prevails for that relationship. Revenue estimates provided before signing are illustrative and not guaranteed.
10. Intellectual property
The PlugEV name, logo, app, website content and software are owned by or licensed to us. We grant you a limited, non-exclusive, non-transferable licence to use the app and website for their intended purpose. You must not copy, modify, reverse-engineer or commercially exploit them without our written permission.
11. Limitation of liability
- We don't exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
- Subject to that, we're not liable for indirect or consequential losses, loss of profit, or losses caused by events outside our reasonable control, including power outages, network failures, extreme weather or acts of third parties.
- Subject to the above, our total liability to a driver for any claim relating to a charging session is limited to the greater of the amount paid for that session or [amount]. Our liability for charger sales is limited to the price paid for the relevant products and services.
12. Suspension and termination
You can close your account at any time in the app. We may suspend or close accounts, or block RFID cards, if we reasonably believe you have breached these Terms, used the Services fraudulently, or failed to pay amounts due. Outstanding amounts remain payable.
13. Changes to these Terms
We may update these Terms to reflect changes in our Services or the law. We'll post the updated Terms on this page and, for material changes, notify account holders in advance. Continuing to use the Services after changes take effect means you accept them.
14. Governing law and disputes
